Welcome to Crash Valuations. By accessing or using our services through crashvaluations.com (the “Site”) or through direct business engagement, you agree to be bound by the following Terms of Service (“Terms”). If you do not agree, please do not use our services.

1. Services Provided

Crash Valuations offers virtual estimating and total loss negotiation services for auto damage claims. We work with body shops, law firms, and vehicle owners to help streamline the claims process and maximize total loss settlements. Our services include (but are not limited to):

Writing professional damage estimates
Preparing supplements for additional damage
Negotiating total loss settlements with insurance companies

2. No Guarantee of Outcome

While we aim to provide high-quality services and successful outcomes, Crash Valuations makes no guarantee regarding claim approval, settlement amounts, or repair outcomes. Insurance companies retain full authority over claim decisions.

3. Disclaimer of Liability for Use of Estimates

All estimates and supplements provided by Crash Valuations are advisory in nature. Final repair decisions, parts selection, and claim submissions are at the discretion of the body shop or vehicle owner. Crash Valuations is not responsible for:

Any modifications made to our estimates or documents by third parties
Delays, underpayments, or denials of claims resulting from changes or misapplication of our work
Any errors or omissions in information provided to us by the user (photos, vehicle info, claim details, etc.)

Use of our estimates does not imply that Crash Valuations is responsible for claim decisions or insurance negotiations outside of direct engagement. Preliminary estimate sales are final. A money-back guarantee, when offered, applies exclusively to supplements.

4. Total Loss Negotiation Terms

For total loss negotiation services, Crash Valuations operates on a contingency basis:

We charge a 20% fee only on the additional amount recovered above the original insurance offer.
No upfront payment is required.
Clients must authorize us to engage in communication with the insurance company.
We are not liable if a higher offer is not obtained or if the client accepts a lower settlement independently.

5. Mutual Referral Understanding

While we may refer clients to personal injury attorneys or body shops, Crash Valuations is not a legal service provider or repair facility and does not endorse or guarantee the services of third-party professionals. Any referrals are provided in good faith, and users are responsible for conducting their own due diligence.

6. User Responsibilities, Fraud, and Misrepresentation

You agree to:

Provide accurate, complete, and current information when submitting a request
Use our estimates and documents for lawful and appropriate purposes
Not falsify, misrepresent, or alter any documents created by Crash Valuations
Not submit staged, fraudulent, or misleading photos, VINs, claim numbers, insurance information, or damage descriptions

Crash Valuations may refuse service, cancel a claim, withhold deliverables, and report suspected fraud to insurers or law enforcement when information appears falsified or misrepresented.

7. Payment Terms

Payment for estimates or services must be made in accordance with the pricing and billing structure agreed upon during service selection. For contingency-based services, payment is due immediately upon successful settlement disbursement to the client. A processing fee may apply to card payments.

8. Refund & Cancellation Policy

All fees paid to Crash Valuations are non-refundable. Services are sold based on access, availability, and reserved estimating capacity, not usage. Unused services, reduced usage, or failure to submit claims do not qualify for refunds or credits. Cancellations may be made at any time but take effect at the end of the current billing period, with no refunds issued for completed or active periods. Any refunds, partial refunds, or credits issued are granted solely at the discretion of Crash Valuations and do not establish precedent.

9. Intellectual Property

All content, estimates, templates, and materials created by Crash Valuations remain the intellectual property of the company and may not be resold, copied, or distributed without written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Crash Valuations shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, claim denials, or reputational damage, arising from use of our services or website.

11. Modifications to Terms

We reserve the right to update these Terms of Service at any time without prior notice. Continued use of our services after changes constitutes acceptance of the revised terms.
